Terms & Conditions

These Terms govern your use of TRUZH. By creating an account or using our platform, you confirm you have read, understood, and agreed to them.

Section 1

About TRUZH

TRUZH operates an online marketplace enabling registered users to list, discover, and exchange second-hand items locally. TRUZH acts solely as an intermediary between buyers and sellers and is not a party to any transaction between users.

TRUZH does not own, inspect, verify, or take responsibility for items listed on the platform. Buyers and sellers transact directly and accept full responsibility for their agreements.

To use TRUZH, you must be at least 18 years old and legally capable of entering into binding contracts under applicable law.

Section 2

Key definitions

Platform

The TRUZH website, mobile applications, and all associated services.

User

Any registered individual using the platform.

Seller / Buyer

Users offering or purchasing items respectively.

Community Listing

A listing visible only to verified members of a specific community (e.g. a university or workplace).

Clan Listing

A listing visible only to members of a specific Clan, an admin-managed private group.

Public Listing

A listing visible to all registered users on the platform.

Business User

A user acting in a professional or commercial capacity, subject to EU P2B Regulation.

Content

Any text, images, or other material submitted to the platform by users.

Section 3

Account registration

When creating an account, you agree to:

  • Provide accurate, complete, and current information
  • Keep your login credentials secure and confidential
  • Update your account details if they change
  • Not share your account or allow others to use it

You are solely responsible for all activity conducted through your account. Each person may hold only one account unless expressly authorised by TRUZH in writing. We reserve the right to suspend or close accounts where false or misleading information has been provided.

Section 4

Listing rules

When creating a listing, you represent and warrant that:

  • You own the item or are authorised to sell it
  • All descriptions, photos, and prices are accurate and not misleading
  • The item complies with all applicable laws and these Terms
  • The item is not on the prohibited list below

Prohibited items

The following may not be listed on TRUZH under any circumstances:

  • Illegal or regulated goods of any kind
  • Counterfeit, replica, or trademark-infringing products
  • Weapons, ammunition, explosives, or dangerous materials
  • Adult or sexually explicit content
  • Live animals or products from protected species
  • Digital-only items: software licences, activation keys, streaming accounts
  • Stolen property or goods obtained through illegal means
  • Prescription medicines or controlled substances

TRUZH reserves the right to remove any listing that violates these rules without prior notice and without liability.

Section 5

Community & Clan verification

Certain features, including access to community-exclusive listings, require verification of your affiliation with a participating university or workplace. This is typically completed via a recognised institutional email domain.

Clans are private trading circles created and managed by an admin user. Membership is by admin invitation or approval, and any personal email may be used. Clan admins are responsible for moderating their group's content and behaviour in accordance with these Terms.

TRUZH may also request additional identity verification where required by law, regulation, or for trust and safety purposes. Failure to provide requested verification may limit your access to certain features.

Section 6

Transactions and payments

Buyers and sellers communicate directly through TRUZH to agree on price, condition, and exchange logistics. TRUZH facilitates communication but is not responsible for the outcome of any individual transaction.

Within Communities and Clans, exchanges may be completed in person with cash or personal online payment methods, or optionally through TRUZH's secured payment system. In the Public Marketplace, all transactions must use TRUZH's secured payment system, which holds funds in escrow until the buyer confirms receipt.

Where online payments are enabled, they are processed by authorised third-party payment providers. TRUZH does not store full payment card details. A minimal service commission may apply to secured online transactions.

TRUZH does not guarantee the quality, safety, legality, or accuracy of any item listed on the platform. Users transact at their own risk.

Section 7

User conduct

All users agree not to:

  • Engage in fraudulent, deceptive, or misleading behaviour
  • Post false, inaccurate, or abusive content
  • Circumvent the platform by arranging transactions off-site to avoid fees or oversight
  • Harass, threaten, or discriminate against other users
  • Use automated tools, bots, or scrapers on the platform
  • Use TRUZH for any unlawful purpose
  • Impersonate another person or entity

Violations of this section may result in immediate account suspension or permanent termination.

Section 8

Intellectual property

TRUZH owns all intellectual property rights in the platform, including its design, software, branding, trademarks, and content produced by TRUZH. The TRUZH name and logo are registered trademarks in Spain.

When you submit content (such as photos or listing descriptions), you grant TRUZH a non-exclusive, royalty-free licence to use, display, and reproduce that content solely for the purpose of operating and promoting the platform.

You retain ownership of your content. You are responsible for ensuring you have the right to share any content you post.

Section 9

Suspension and termination

TRUZH may suspend or permanently close accounts that:

  • Breach these Terms
  • Violate applicable laws
  • Engage in behaviour harmful to the platform or other users
  • Fail to cooperate with trust, safety, or verification requests

In cases of serious violations, accounts and listings may be removed without prior notice. You may close your account at any time by contacting contact@truzh.com.

Section 10

Tax obligations & DAC7 reporting

Users are personally responsible for understanding and fulfilling their applicable tax obligations in their jurisdiction.

Under EU Directive DAC7, TRUZH is legally required to collect and report certain seller information to tax authorities when regulatory thresholds are exceeded (typically more than 30 transactions or €2,000 in annual sales). Sellers meeting these thresholds will be notified and asked to provide relevant tax identification information.

Important: If you are unsure about your tax obligations, consult a qualified tax advisor in your country of residence.

Section 11

Business users: EU P2B Regulation

If you sell on TRUZH in a professional or commercial capacity, EU Platform-to-Business Regulation (EU 2019/1150) applies. As a Business User, you are entitled to:

  • Transparency regarding how TRUZH ranks listings
  • A clear description of how to access dedicated complaint-handling processes
  • At least 15 days' notice before any significant changes to these Terms
  • Access to a dedicated business complaints channel

Section 12: Fees

Creating an account and publishing listings on TRUZH is free of charge. A minimal service commission applies only to TRUZH-secured online payments. TRUZH Pro is an optional paid subscription with advanced features. All pricing is clearly displayed before you confirm any payment. We reserve the right to modify our fee structure with reasonable advance notice to users.

Section 13

Limitation of liability

TRUZH provides the platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by applicable law, TRUZH is not liable for:

  • Loss, damage, or theft arising from transactions between users
  • Inaccurate or fraudulent listings created by users
  • Platform downtime, errors, or interruptions
  • Indirect, consequential, or special damages of any nature

Nothing in these Terms limits TRUZH's liability for fraud, gross negligence, or any liability that cannot be excluded by law.

Section 14

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory consumer protection law in your country of residence requires otherwise.

If you are a consumer located in the EU, you may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Section 15: Changes to these Terms

TRUZH reserves the right to amend these Terms at any time. For significant changes, we will provide at least 15 days' notice via email or a prominent notice on the platform. Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.

Section 16: Privacy and data protection

Your personal data is processed in accordance with our Privacy Policy and Cookie Policy. By using the platform, you acknowledge these documents and agree to their terms.
